Case Summary: A woman’s family came to our office after she was detained by ICE. It turned out that she had missed a previous court date and had been ordered deported. After discussing with the client the difficulty of her case, she asked that we take every possible step to try and reopen her case and get her out of custody. It turned out that she was in an abusive relationship with a U.S. citizen. The U.S. citizen had committed some horrible acts against her and their children. We used this as a basis to reopen her case, arguing that the husband had manipulated and controlled the client to a point where she warrants reopening of her case. In a trial on the merits of her application to remain in the US due to the domestic abuse and mental cruelty, the judge agreed that the client was a victim of extreme mental cruelty and granted her permanent residency and release from custody.
