Case Summary: A permanent resident was arrested for a crime 15 years ago, not knowing that pleading guilty would potentially harm his ability to leave the United States and return without issue. When he went on a trip abroad and came back, Border Patrol stopped him, detained him, and placed him into removal proceedings. Our office made an argument that it was unlawful to detain this person and try to remove him because the crime did not categorically qualify as a deportable offense. The judge disagreed and said he was still deportable. We then shifted our focus to arguing that the client deserved a special inadmissibility waiver that granted permanent residents the chance to stay in the United States if they show the positives in their life outweigh the negatives. The judge granted the case. That person then used our services to apply for citizenship and is now a US citizen.
